Terms

Last updated: [date of launch]

These terms cover using this website and buying from Martinez Antiques. They don't affect your legal rights as a consumer.

Who we are

Martinez Antiques, 17 Brandon Terrace, Canonmills, Edinburgh EH3 5DZ. [Legal name and business type]. Email jmartinezantiques@gmail.com or phone 0131 558 8720.

Items on this website

We describe every item as accurately as we can, but please bear in mind:

  • Antiques show their age. Expect wear, marks and past repairs that suit the item's age. We mention any significant restoration we know about.
  • Measurements are approximate.
  • Colours can look different on screen. If the exact colour or condition matters, please ask us or come and see the item.
  • Prices are in pounds sterling and may change. "Price on request" means please contact us for the price.
  • Availability. Items marked Reserved are held for another customer. Items marked Sold are shown for reference only. Very occasionally an item may sell in the shop before the website is updated.

The website isn't an offer to sell. You can't buy online: please email, phone or visit us.

Buying from us

A sale is agreed when we confirm it with you and you've paid in full. The item remains ours until it's paid for.

Payment. Clocks and repairs by bank transfer or cheque. Lighting and jewellery by bank transfer, cheque or credit card (Visa, Maestro and Mastercard, not American Express). Items are released once a cheque has cleared.

Reservations. We're happy to reserve an item for a short time by arrangement. [How long, and whether a deposit is needed.]

Your rights

Under the Consumer Rights Act 2015, anything you buy from us must be as described, of satisfactory quality and fit for purpose. For an antique, "satisfactory quality" takes its age and price into account. If something isn't right, please contact us straight away and we'll put it right.

[Clock guarantee, if offered: e.g. "Clocks we sell come with a [12-month] guarantee covering the movement under normal use."]

Buying without visiting the shop

[Include this section only if items are ever sold by phone or email without the customer visiting.]

If you buy an item without visiting us, you can cancel within 14 days of receiving it, without giving a reason. Tell us by email or phone, then return the item in the same condition. We'll refund you, including the standard delivery cost, within 14 days of getting it back. [Who pays to return it.]

Delivery and collection

[Whether you deliver or post items, to where, and how it's charged. Larger items such as longcase clocks and chandeliers may need specialist delivery or installation.]

Repairs

We repair clocks (not watches), restring pearls and beads, and rewire lamps. Our goldsmith repairs silver and gold jewellery and resizes rings. Estimates are free. We'll agree the price with you before starting any work. [What happens to items not collected after a repair.]

Our responsibility to you

We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to take reasonable care. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for your rights as a consumer.

Law

These terms are governed by Scots law. If you live elsewhere in the UK, you can also bring proceedings in your own country's courts.

Changes

We may update these terms from time to time. The terms in force when you buy an item apply to that purchase.
